Terms of Service

These Terms of Service (“Terms”) govern your use of the Eagle Mountain Parks mobile application and website (together, the “Service”). The Service is operated by Jessie Southworth, an individual based in Utah, USA (“we”, “us”, “our”).

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. The Service is not the city

Eagle Mountain Parks is not affiliated with, endorsed by, or operated by Eagle Mountain City or any other government entity. It is a community-sourced reporting tool operated independently by a single individual.

Reports submitted through the Service are not official communications with the city. Submitting a report through the Service does not notify city staff, dispatch crews, or create a service request. To report an issue to the city directly, use the city’s official channels.

The Service is not an emergency service. Do not use it to report emergencies. In an emergency, call 911.

2. Eligibility

You must be at least 13 years old to use the Service. By creating an account, you confirm that you are at least 13. If you are between 13 and 17, you confirm that a parent or legal guardian is aware of and consents to your use of the Service.

3. Your account

  • You are responsible for all activity on your account.
  • You agree to provide accurate information and to keep your account credentials secure.
  • You agree not to share your account with others or to create more than one account for yourself.
  • If you suspect your account has been compromised, contact us at jessie@soudub.com promptly.

4. Your content

When you submit reports, comments, photos, or other content (collectively, “User Content”) through the Service:

  • You retain ownership of your User Content.
  • You grant us a worldwide, royalty-free, perpetual, non-exclusive license to host, display, distribute, modify, and create derivative works of your User Content, for the purposes of operating and improving the Service and any associated services, including any future map exports, analyses, or board-packet PDFs assembled from community-submitted data.
  • You grant other users a worldwide, royalty-free license to view your approved User Content as part of the Service.
  • You confirm that you have the right to submit the User Content and that submitting it does not violate any law or third-party right.

5. Public visibility of approved content

Reports approved by moderators are publicly visible to all users — including the title, description, category, location, attached photos, and your display name. Do not include personal information you don’t want to be public when submitting reports.

6. Acceptable use

You agree not to:

  • Submit false, misleading, or deceptive reports.
  • Submit content that is unlawful, harassing, defamatory, threatening, hateful, or discriminatory.
  • Submit profanity. The Service enforces a word blocklist; submissions containing blocked terms are rejected automatically.
  • Submit photos containing identifiable faces of other people (especially children) without their consent.
  • Submit photos containing license plates, home addresses, or other personally identifying information about people who haven’t consented.
  • Use the Service to track, surveil, or harass any person.
  • Misrepresent your affiliation with the City of Eagle Mountain or any other government entity.
  • Attempt to gain unauthorized access to the Service, other users’ accounts, or the underlying systems.
  • Use automated means (bots, scrapers, headless clients) to access the Service.
  • Reverse-engineer, decompile, or otherwise attempt to derive the source code of the Service, except where this restriction is prohibited by applicable law.

7. Moderation

All reports are reviewed by volunteer moderators before becoming publicly visible. Moderators may approve, reject, edit, archive, or remove any User Content at our discretion, with or without prior notice. We may suspend or terminate accounts that violate these Terms or whose content repeatedly fails moderation.

8. Termination

You may delete your account at any time through Profile → Delete account. Approved reports you’ve submitted remain on the public map but are anonymized — your display name is removed.

We may suspend or terminate your access to the Service at any time, with or without notice, for violations of these Terms or for any other reason we consider in good faith to be necessary to protect the Service, its users, or the operator.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING (BUT NOT LIMITED TO) WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

REPORTS, COMMENTS, AND STATUSES SHOWN IN THE SERVICE ARE COMMUNITY-SOURCED AND MAY BE INACCURATE, INCOMPLETE, OR OUT OF DATE. WE MAKE NO REPRESENTATIONS ABOUT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY REPORT. RELY ON THE SERVICE AT YOUR OWN RISK.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

The Service is operated by an individual, not a corporation. There is no corporate liability shield; the disclaimers and limitations above are the sole protection between you and the operator personally.

11. Indemnification

You agree to indemnify, defend, and hold harmless Jessie Southworth from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or relating to: (a) your User Content, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) your use of the Service.

12. Governing law and disputes

These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-laws principles. Any disputes arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Utah County, Utah, and you consent to personal jurisdiction in those courts.

13. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent changes. Material changes will be communicated through an in-app notice prior to taking effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect.
